These Terms and Conditions (“Terms”) govern your use of brightwellmarket.com (the “Site”) and your purchase of products from Brightwell Market, operated by KJONGSys LLC (“we”, “us”, “our”). 1. Who we are
Brightwell Market is an online retail store operated by KJONGSys LLC, a limited liability company organized under the laws of the United States. You can contact us at [email protected].
2. Eligibility
The Site is intended for use by residents of the United States who are at least 18 years old, or who use the Site under the supervision of a parent or legal guardian. We sell and ship only within the United States.
3. Products and pricing
We work to describe our products accurately, but we do not warrant that product descriptions, images, colors, or other content are error free. All prices are in US dollars and may change at any time without notice. Price changes do not affect orders already placed. In the event of an obvious pricing error, we reserve the right to cancel affected orders and refund any payment received.
4. Payments and billing
Payment is due in full at the time you place your order. By submitting an order, you authorize us to charge your selected payment method for the total order amount, including any shipping charges and applicable taxes, at the time the order is placed.
Payments are processed securely by Stripe on behalf of KJONGSys LLC, the company that operates Brightwell Market and is the merchant of record for all purchases made on the Site. Your card details are transmitted directly to Stripe over an encrypted connection, and we do not store your full card details on our servers.
Statement descriptor notice: because payments are processed under our operating company, the charge on your card or bank statement may appear as KJONGSYS or KJONGSys LLC rather than Brightwell Market. If you see a charge under either of these names, it is your Brightwell Market order. Please contact us before disputing any charge you do not recognize.
When you place an order, you receive a confirmation email. This confirms receipt of your order, not our acceptance of it. We reserve the right to refuse or cancel any order, for example where fraud is suspected, stock is unavailable, or a pricing error occurred. If we cancel a paid order, you receive a full refund.
5. Shipping and delivery
Orders are processed within 1 to 3 business days and typically delivered within 7 to 15 business days after shipping. Shipping is free on orders of $50 or more, and $4.99 otherwise. 6. Returns and refunds
Returns are accepted within 30 days of delivery as described in our Returns and Refunds Policy, which forms part of these Terms. Refunds are issued through Stripe to your original payment method and typically appear within 5 to 10 business days after approval. Orders may be cancelled within 12 hours of placement; after that, cancellation is not guaranteed.
7. Chargebacks and disputes
If you have a problem with a charge or an order, please contact us at [email protected] before opening a dispute or chargeback with your bank or card issuer. We reply within 1 business day and can resolve most issues, including refunds for legitimate problems, far faster than the chargeback process. Keep in mind that charges appear on your statement as KJONGSYS or KJONGSys LLC, so a charge you do not recognize is most likely your Brightwell Market order. We reserve the right to contest chargebacks that we believe are filed in error or are fraudulent, and to provide the card networks with order, delivery, and communication records as evidence.
8. Accounts
You may create an account or check out as a guest. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts used in violation of these Terms.
9. Acceptable use
Your use of the Site is subject to our Acceptable Use Policy, which forms part of these Terms. In summary, you agree not to use the Site for any unlawful purpose, to place fraudulent orders, to interfere with the Site’s operation, to attempt to gain unauthorized access to any systems, or to scrape or copy content in bulk without permission.
10. Intellectual property
All content on the Site, including text, graphics, logos, and design, and the Brightwell Market brand itself, is owned by or licensed to KJONGSys LLC and is protected by applicable intellectual property laws. You may not reproduce or exploit Site content for commercial purposes without our written permission.
11. Disclaimer of warranties
The Site and all products are provided “as is” and “as available”, except as expressly stated in these Terms or required by law. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non infringement. Nothing in these Terms limits warranties or rights that cannot be limited under applicable law, including rights you may have under your state’s consumer protection laws.
12. Limitation of liability
To the fullest extent permitted by law, KJONGSys LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations of liability, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless KJONGSys LLC and its members, officers, and agents from claims arising out of your violation of these Terms or misuse of the Site.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the laws of the state in which KJONGSys LLC is organized, without regard to conflict of law principles.
